The Water Board issued a Notice of Proposed Emergency Rulemaking, under which it claims to have the power to issue curtailment notices as part of the drought emergency to any diverter, including riparians and pre-1914 appropriators. The Water Board's proposal has not yet been tested, but a decision has just been issued by a California court of appeal holding that the Board possesses the power to regulate and curtail use even by senior rights holders
